Terms & Conditions

Follow The Market Ltd. ("FTM", "we", "us", "our") — Last updated: 12 October 2026. This document should be reviewed by qualified legal counsel in every jurisdiction FTM operates in before being relied upon as a binding, enforceable contract.

Plain-language summary (this does not replace the full terms below): FTM provides automated trading technology and account-management tooling. We do not provide financial, investment, tax, or legal advice. Trading involves substantial risk of loss, including total loss of capital, and you alone bear that risk. Subscription fees are non-refundable, subject to the verification window described in Section 6. Participation in the FTM Investment Programme is subject to the five-year term, the withdrawal rules and the 50% profit share described in Section 7. By checking the agreement box anywhere on this site, you accept every term below in full.

1. Acceptance of these Terms

These Terms & Conditions ("Terms") form a legally binding agreement between you ("Customer", "you", "your") and Follow The Market Ltd. ("FTM", "we", "us", "our") governing your access to and use of the FTM website (ftmwealthnation.com), the FTM MACHINE automated trading subscription service, the FTM Investment Programme, the FTM client dashboard, and any related services, tools, content, or communications we make available (collectively, the "Services").

By accessing the Services, creating an account, submitting payment, or otherwise using the Services in any manner, you confirm that you have read, understood, and irrevocably agree to be bound by these Terms in their entirety, without modification. If you do not agree to any part of these Terms, you must not access or use the Services.

Paying for any FTM product or service — including, without limitation, a FTM MACHINE Subscription or a contribution to the FTM Investment Programme — constitutes your full and binding acceptance of these Terms in their entirety, whether or not you separately tick, sign, or otherwise indicate agreement at the point of payment.

You further confirm that you are entering into these Terms as a principal and not as an agent for any other person, unless separately disclosed to and accepted in writing by FTM.

2. Definitions

  • "Account" means your FTM customer account created via the website, and/or any external trading account (e.g. MT5, broker-hosted account) you connect to the Services.
  • "Subscription" means any paid plan granting access to FTM MACHINE, including but not limited to the Annual, 5-Year, and Lifetime plans, and any successor or replacement plan.
  • "FTM MACHINE" means FTM's proprietary and/or third-party-integrated automated trading software, algorithms, signals, and related infrastructure made available to subscribed Customers.
  • "Investment Programme" means the separate arrangement described in Section 7 under which FTM manages or facilitates trading of Customer capital on a profit-sharing basis, distinct from a FTM MACHINE Subscription.
  • "Broker" or "Trading Account Provider" means any third-party regulated or unregulated entity through which a Customer's actual trades are executed, including but not limited to Deriv and any MT5-compatible broker.
  • "Content" means all text, graphics, data, software, performance figures, marketing material, and other material made available through the Services.
  • "Losses" means any and all financial loss, consequential loss, loss of profit, loss of capital, or other damage howsoever arising.

3. Description of Services

FTM offers technology and facilitation services related to algorithmic and automated trading in financial markets, including but not limited to foreign exchange (forex), contracts for difference (CFDs), synthetic indices, commodities, cryptocurrencies, and other instruments made available via connected Brokers. The Services offered under these Terms include, without limitation:

  • Provision of access to FTM MACHINE, an automated trading engine that connects to a Customer's own eligible trading account and executes trades according to configured strategies, risk parameters, and market conditions;
  • A client dashboard allowing Customers to view account status, connection status, historical executions, open positions, deposits and withdrawals, and subscription details;
  • Tools to connect, disconnect, pause, and manage one or more external trading accounts for use with FTM MACHINE, subject to the one-account-active-at-a-time model described on the Services;
  • The FTM Investment Programme, a separate profit-sharing capital arrangement described fully in Section 7;
  • Customer support via email, live chat, and other channels made available from time to time;
  • Educational, marketing, and informational content regarding trading, markets, and the Services, none of which constitutes financial, investment, legal, or tax advice;
  • A referral and introducing-partner/affiliate programme, subject to separate partner terms where applicable;
  • Any other feature, tool, or service FTM may introduce, modify, or discontinue at its sole discretion from time to time.

FTM does not itself act as a broker, custodian, or counterparty to Customer trades. Trades are executed on the Customer's own account held with a Broker of the Customer's choosing (or, where facilitated, a Broker introduced by FTM), and FTM's role is limited to providing the automated trading technology and related tooling that acts upon that account pursuant to authorisation granted by the Customer.

FTM reserves the right to modify, suspend, expand, restrict, or discontinue any feature of the Services, in whole or in part, temporarily or permanently, at any time and without liability, subject only to any notice requirements imposed by applicable law.

4. Eligibility, Account Registration & KYC/AML

To use the Services you must be at least 18 years of age (or the age of legal majority in your jurisdiction, if higher), have full legal capacity to enter into binding contracts, and not be a resident of, or otherwise subject to, any jurisdiction in which use of the Services would be unlawful, including jurisdictions subject to comprehensive sanctions regimes administered by the United Nations, the European Union, the United States (OFAC), the United Kingdom (OFSI), or any other applicable body.

You must provide accurate, current, and complete information when registering an Account and when connecting any trading account, and must promptly update such information if it changes. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your Account, whether or not authorised by you, except to the extent such activity results from FTM's gross negligence or wilful misconduct.

FTM reserves the right, but not the obligation, to require identity verification (Know Your Customer, "KYC") and to conduct anti-money-laundering ("AML") and counter-terrorist-financing ("CTF") checks before, during, or after providing the Services, consistent with applicable EU and international AML/CTF frameworks referenced in Section 14. FTM may refuse, suspend, or terminate the Services to any person who fails to complete such verification to FTM's satisfaction, or who is found to be a Politically Exposed Person, sanctioned individual/entity, or otherwise presents unacceptable risk, without liability to FTM.

5. No Financial Advice; Risk Disclosure

This is the single most important section of these Terms. Read it carefully.

Nothing provided by FTM through the Services — including but not limited to FTM MACHINE's trading activity, dashboard data, performance statistics, marketing material, educational content, customer support communications, or any statement by any FTM representative — constitutes financial advice, investment advice, legal advice, tax advice, or a personal recommendation within the meaning of any applicable securities or financial services law, including MiFID II (Directive 2014/65/EU) as implemented across the European Economic Area.

FTM is not, and does not hold itself out to be, a regulated investment adviser, portfolio manager, broker-dealer, or financial institution authorised to provide individualised investment recommendations in any jurisdiction, unless and until expressly stated otherwise in writing with reference to a specific licence and regulator. Any reference on the Services to "auto-trading", "investment", "returns", "growth", or similar terminology describes the mechanical operation and marketing positioning of the Services and must not be construed as a promise, guarantee, or advice of any kind.

You expressly acknowledge and agree that:

  • Trading foreign exchange, CFDs, synthetic indices, cryptocurrencies, and other leveraged or volatile instruments carries a high level of risk and may not be suitable for all investors;
  • You may lose some or all of your invested or connected capital, and in the case of leveraged products, you may lose more than your initial deposit and may be liable to your Broker for additional sums;
  • Past performance, including any performance figures, statistics, or track record displayed on the Services, is not indicative of future results, and no representation is made that any Customer is likely to achieve profits or losses similar to those shown;
  • Automated and algorithmic trading systems, including FTM MACHINE, can and do experience losing trades, drawdowns, technical failures, slippage, latency, and periods of underperformance, and no automated system can guarantee profit or eliminate risk of loss;
  • Market conditions including volatility, liquidity gaps, broker execution quality, spreads, swap/rollover charges, and macroeconomic events are outside FTM's control and materially affect trading outcomes;
  • You are solely responsible for evaluating the merits and risks of using the Services and for any decision to fund, maintain, or withdraw from any connected trading account, having regard to your own financial circumstances, objectives, and risk tolerance, and you are strongly encouraged to seek independent financial, legal, and tax advice from a duly licensed professional before using the Services;
  • You alone bear full responsibility for any and all Losses arising from use of the Services, including Losses arising from trades executed by FTM MACHINE on your connected account, save only where such Losses are proven to result directly from FTM's fraud or wilful misconduct.

6. Fees, Billing & Refund Policy

Access to FTM MACHINE requires payment of the applicable Subscription fee in full, in advance, via the payment methods made available on the Services (including third-party payment processors such as Stripe). Prices are as displayed on the Services at the time of purchase and are subject to change for future purchases without affecting Subscriptions already paid for.

6.1 Non-Refundable by Default

All Subscription fees are non-refundable. By purchasing a Subscription, you acknowledge that you are paying for immediate access to a digital service that begins performance upon activation, and, to the fullest extent permitted by applicable law (including any statutory withdrawal right that might otherwise apply to distance contracts, such as under the EU Consumer Rights Directive 2011/83/EU), you expressly request immediate performance of the Services and acknowledge that you thereby waive any right to a cooling-off refund once the Services have commenced, where such waiver is permitted by applicable law.

6.2 Verification Window

Where FTM, at its sole discretion, agrees to consider a refund request outside of the default non-refundable policy (for example, in cases of demonstrable non-delivery of the Services), any such refund is conditional on FTM first verifying that the Subscription and/or connected trading account has not been used, activated, or otherwise engaged with FTM MACHINE. This verification process may take up to two (2) months from the date of the request to complete, owing to the need to review account activity, connection logs, and trading history across the relevant period. No refund will be issued, in whole or in part, where FTM's verification shows that the Subscription or the connected account was used, activated, or engaged with FTM MACHINE at any point, even briefly, during the Subscription period.

The existence of this verification process does not create any right to a refund; it solely describes the process FTM will follow on the rare occasions it chooses, or is legally required, to consider one.

6.3 Chargebacks

Initiating a chargeback or payment dispute with your card issuer or payment provider without first pursuing resolution through FTM support constitutes a material breach of these Terms and may result in immediate suspension or termination of your Account and pursuit of the disputed amount plus associated costs.

6.5 Refunds by Service

  • FTM MACHINE (Auto Trading) Subscriptions. No refunds. Subscription fees are final once paid, in line with Section 6.1.
  • FTM Investment Programme. A request for the return of invested capital can be raised only after one (1) year from the date of the investment, and not before. Any refund is limited to the value of the Customer's capital at the time the request is processed. Where the investment has made a loss at that time, the loss is borne by the Customer and the amount returned is reduced accordingly. The terms of Section 7 continue to apply.

6.4 Taxes

All fees are exclusive of any applicable value-added tax, goods and services tax, withholding tax, or similar levy, which shall be added where legally required. You are solely responsible for determining and paying any taxes arising from your use of the Services or from any trading profits.

7. FTM Investment Programme — Term, Withdrawals & Profit Share

Where a Customer elects to participate in the FTM Investment Programme (as distinct from, and in addition to, a standard FTM MACHINE Subscription), the following additional terms apply and are incorporated into, and form part of, these Terms in full:

  • Term and capital. Capital committed under the Investment Programme remains invested for a term of five (5) years from the date of initial funding. No withdrawal of capital is permitted during the term except at FTM's sole discretion.
  • Withdrawals of profit share. In the thirteenth (13th), twenty-fifth (25th), thirty-seventh (37th) and forty-ninth (49th) months of the term, an allowance of twenty percent (20%) of the profit share not yet withdrawn on that day unlocks. Unlocked allowances not yet taken remain available and may be withdrawn at any time until the end of the term, in one or several requests. At the end of the fifth (5th) year, the Customer receives the capital together with all remaining profit share.
  • Profit share. The Customer's profit share is fifty percent (50%) of the profit the FTM master account makes on the Customer's capital, unless a different split is expressly agreed in writing for a specific Customer or programme tier.
  • No guarantee. The profit share applies only to net profits actually realised. It does not constitute a guaranteed return, fixed yield, or interest payment of any kind, and FTM makes no representation as to the amount, if any, of profit that will be generated during the term. Section 5 and Section 9 apply in full to the Investment Programme.
  • Losses. Trading losses incurred under the Investment Programme reduce the Customer's capital directly and are not split, offset, or otherwise absorbed by FTM, except where FTM expressly agrees otherwise in writing.
  • Early withdrawal. Any withdrawal of capital requested before the end of the five-year term, or of profit share beyond the unlocked allowances, is granted solely at FTM's discretion and may be subject to reduced profit allocation, forfeiture of accrued but undistributed profit share, administrative fees, or refusal, as determined by FTM.
By checking the agreement box on this website when enrolling in the FTM Investment Programme, or when purchasing any FTM MACHINE Subscription, you confirm that you have read, understood, and agree to be bound by the entirety of these Terms, including without limitation the five-year term, the withdrawal rules and the 50% profit share described in this Section 7, and the non-refundable fee policy described in Section 6.

8. Trading Account Connection & Authorisation

By connecting a trading account (e.g. an MT5 account with a Broker such as Deriv) to FTM MACHINE, you grant FTM a limited, revocable authorisation to place, modify, and close trades on that account strictly in accordance with the configured strategy and risk settings of FTM MACHINE, for so long as the connection remains active. You represent and warrant that you are the lawful owner or authorised operator of any account you connect, and that connecting it to FTM MACHINE does not breach any agreement you have with your Broker or any third party.

FTM MACHINE trades on only one connected account at a time per Customer configuration as displayed on the Services. Connecting a new account will close open positions on the previously active account before trading begins on the new one, as described on the Services. You may disconnect, pause, or reconnect an account at any time via the dashboard, subject to any in-progress trade completing first where immediate closure is not possible or prudent.

You remain, at all times, the account holder and principal responsible for the connected account, including for funding it, for any margin calls, for any fees or charges levied by the Broker, and for compliance with the Broker's own terms of service.

9. Performance Data & No Guarantee

Any performance figures, statistics, leaderboard rankings, trade history, or similar data displayed on the Services reflect historical, account-specific outcomes and are provided for informational purposes only. Such data is not audited by an independent third party unless expressly stated otherwise, may reflect a limited time period or a curated selection of accounts, and must not be relied upon as representative of results any particular Customer will achieve. Hypothetical, simulated, or back-tested performance, where shown, has material limitations and does not reflect actual trading, and results may differ materially from live trading due to factors including but not limited to slippage, liquidity, and execution timing.

10. Prohibited Conduct

You must not, and must not attempt to: (a) use the Services for any unlawful purpose, including money laundering or terrorist financing; (b) circumvent, disable, or interfere with any security, rate-limiting, or authentication feature of the Services; (c) reverse-engineer, decompile, or attempt to extract the source code or underlying methodology of FTM MACHINE; (d) use the Services to trade on behalf of a third party without FTM's prior written consent; (e) provide false, misleading, or stolen identity or payment information; (f) resell, sublicense, or provide access to the Services to any third party without authorisation; or (g) engage in any conduct that FTM reasonably determines is harmful to FTM, other Customers, or the integrity of the Services.

11. Intellectual Property

All Content, trademarks, the "FTM" and "Follow The Market" names and logos, software, algorithms, and underlying technology comprising the Services are the property of FTM or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in such Content or technology beyond a limited, non-exclusive, non-transferable, revocable licence to use the Services in accordance with these Terms for their intended purpose.

12. Data Protection & Privacy (GDPR)

Where FTM processes personal data of individuals located in the European Economic Area or United Kingdom, it does so as a data controller (or, in some cases, processor) in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, "GDPR") and, where applicable, the UK GDPR and Data Protection Act 2018. Personal data is collected and processed for purposes including account administration, KYC/AML compliance, service delivery, fraud prevention, and marketing (where consented to), and is retained only for as long as necessary for those purposes or as required by law. You have rights including access, rectification, erasure, restriction, portability, and objection, exercisable by contacting FTM using the details in Section 24. Full details are set out in FTM's separate Privacy Policy, which forms part of these Terms by reference.

13. Regulatory Status & Jurisdictional Disclosures

FTM's regulatory status, licensing, and permissions vary by jurisdiction and by the specific service offered, and may change over time as FTM pursues or obtains licences, appointed-representative/Haftungsdach arrangements, or passporting rights in various markets. Nothing on the Services should be read as a representation that FTM holds a specific licence or authorisation in your jurisdiction unless expressly and specifically stated, with the relevant regulator and licence/registration number identified, elsewhere on the Services or in writing to you. It is your responsibility to determine whether your use of the Services is lawful in your jurisdiction of residence, and FTM reserves the right to restrict or refuse the Services to residents of any jurisdiction at its sole discretion.

14. EU & International Regulatory Framework References

References to the above frameworks are for context and risk-management purposes and do not constitute a representation, warranty, or admission that any specific instrument applies to FTM's operations in any given jurisdiction, nor that FTM holds any specific authorisation thereunder.

15. Third-Party Services & Brokers

The Services may link to, integrate with, or rely on third-party services, including Brokers (e.g. Deriv), payment processors (e.g. Stripe), authentication providers (e.g. Supabase), and hosting providers. FTM is not responsible for the acts, omissions, terms, fees, execution quality, solvency, or regulatory status of any third party, and your use of such third-party services is governed by their own terms, which you are responsible for reviewing and accepting separately.

16. Limitation of Liability

To the maximum extent permitted by applicable law, FTM, its directors, officers, employees, contractors, and affiliates shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading losses, arising out of or in connection with the Services, whether based on contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, FTM's total aggregate liability to you for any and all claims arising from or relating to the Services shall not exceed the total Subscription fees actually paid by you to FTM in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

17. Indemnification

You agree to indemnify, defend, and hold harmless FTM and its directors, officers, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your use or misuse of the Services; (c) your violation of any law or the rights of any third party; or (d) any trading activity conducted on an account connected by you, including where conducted by FTM MACHINE pursuant to your authorisation.

18. Disclaimers of Warranties

The Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. FTM does not warrant that FTM MACHINE will be profitable, that the Services will be free of downtime, bugs, or security vulnerabilities, or that any defect will be corrected.

19. Suspension & Termination

FTM may suspend or terminate your access to the Services, in whole or in part, at any time and without prior notice, where FTM reasonably believes you have breached these Terms, engaged in prohibited conduct, presented AML/sanctions risk, or where required by law or by a Broker or payment processor. You may close your Account at any time, subject to the non-refundable fee policy in Section 6 and the term and withdrawal provisions in Section 7. Sections of these Terms which by their nature should survive termination (including Sections 5, 6, 7, 9, 16, 17, and 21) shall survive.

20. Force Majeure

FTM shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemic, governmental action, internet or telecommunications failure, broker or exchange outage, power failure, or cyberattack.

21. Dispute Resolution & Governing Law

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall first be submitted to FTM's customer support for good-faith informal resolution. If not resolved within thirty (30) days, the parties agree that such dispute shall be referred to and finally resolved by binding arbitration or the courts of competent jurisdiction identified in FTM's jurisdiction-specific supplementary terms, to the exclusion of the courts of any other jurisdiction, save where mandatory consumer-protection law grants you the right to bring proceedings in your own jurisdiction of residence, which right is preserved to the extent it cannot lawfully be waived.

22. Changes to these Terms

FTM may amend these Terms at any time by posting an updated version on the Services with a revised "Last updated" date. Material changes will, where practicable, be notified to Customers via email or dashboard notice. Continued use of the Services after such changes take effect constitutes acceptance of the amended Terms. If you do not agree to an amendment, your sole remedy is to stop using the Services and close your Account, subject to Sections 6 and 7.

23. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with FTM's Privacy Policy and any jurisdiction-specific or programme-specific supplementary terms expressly incorporated by reference, constitute the entire agreement between you and FTM regarding the Services and supersede all prior agreements and understandings.

24. Notices & Contact

Notices to FTM should be sent to the support contact published on the Services. FTM may provide notices to you via the email address or dashboard associated with your Account. Follow The Market Ltd. reserves all rights not expressly granted in these Terms.
